Consumer Law Practice Unit

Module descriptions

Module 1 – Overview

In this Module you will examine some of the important resources and legislation in Consumer Law. The area of Consumer and Consumer Credit Law is extremely complex. It covers a range of products and services, includes the common law and State and Federal legislation, industry and professional charters and codes of practice and numerous categories of dispute resolution procedures and fora.

Module 2 – Consumer Protection Law

In this Module you will look at the consumer protection role played by two of the most frequently used pieces of legislation which are the

  1. Fair Trading Act 1999 - concerning unfair practices, unfair contractual terms and off-business-premises sales (the FTA)
  2. Motor Car Traders Act 1986 - regulating the conduct of traders in second-hand cars (the MCTA).

Module 3 – Consumer Credit

In this Module you will consider Consumer credit contracts and disputes arising from them as these form an important part of practice in Consumer Law. Consumer credit contracts are regulated by uniform legislation adopted throughout Australia. The national template is the Consumer Credit Code, adopted in Victoria by the Consumer Credit (Victoria) Act 1995.

Module 4 – Consumer Dispute Resolution

In this Module you will examine some of the Consumer Dispute Resolution avenues including whether an appropriate dispute resolution avenue exists for a particular fact situation and the advantages and disadvantages of a particular dispute resolution avenue for a client.

Module 5 - Summary

In this Module you will review the Unit, check that you have completed all of the required activities and complete the online Unit evaluation form.
